M-O.COM is provided solely for the use of M-O customers either current or future, to enable interaction with Maritime-Ontario and may not be used by any person or entity or for any other purpose. All rating, shipment, tracking receiving or remittance of invoices and preparation of documents and any other information and services is for the exclusive use by current and potential M-O customers for their own shipments. Use of M-O.COM to prepare shipments by or for the benefit of third party shippers is prohibited.

 

3-Ownership

The website and its contents are the intellectual property of Maritime-Ontario, its affiliates or licensors. The content is protected by Canadian and international copyright trademark and other laws. You may not deal with any Content in any way other than in accordance with the specific rights allowed under this Terms of Use. It is expressly prohibited to copy, reproduce, translate, distribute export, import, upload, download, reverse engineer, or modify any part of M-O.COM.

 

4-Submissions

Maritime-Ontario does not accept ideas, concepts for new services or products through the website. If such information or comments are received Maritime-Ontario will have no obligation to maintain such information confidential, you are granting Maritime-Ontario unrestricted use to communicate, distribute and exploit such comments anyway it chooses.

 

5-Limitation of liability

Use of M-O.COM and its contents is at your sole risk. Maritime-Ontario will in no event be liable to you or any person or entity claiming through you for incidental, indirect, exemplary, consequential or other damages under any theory of law for any errors in or the use of or inability to use the Website or M-O.COM and its content inclusive of lost data or business interruption and whether or not Maritime-Ontario is advised of the possibility of such damage.

You agree to indemnify and hold harmless Maritime-Ontario, its parent and affiliate companies and their respective officers, directors, employees and agents and representatives from any and all claims as a result of your breach of any of these terms and conditions inclusive of any of your activities performed in connection with this website.

 

8-Jurisdiction and Forum

This Agreement and Your use of M-O.com is governed by and construed in accordance with the laws of Canada and the Province of Ontario excluding its conflict of law rules. If for any reason a court of competent jurisdiction finds any provision of this Agreement to be unenforceable, that provision shall be enforced to the maximum extent permissible. Notwithstanding any provision of this section of the Terms of Use, Maritime-Ontario shall be free to seek interim or injunctive relief before the court of competent jurisdiction within the City of Brampton, Ontario. This Agreement may not be altered or modified without the written consent of Maritime-Ontario.

Maritime-Ontario has no control over the content of Linked Websites and makes no representations or warranties related to the Linked Websites or their content. Maritime–Ontario in its sole discretion may terminate, suspend your use of the Website and Content at any time without notice regardless of whether the Website.
